Terms of Service

Important: Searchmarq is a filing preparation and trademark research service, not a law firm. We do not provide legal advice. Use of our services does not create an attorney-client relationship. For legal advice, please consult a licensed trademark attorney.

1. What Searchmarq Is

Searchmarq provides trademark search, monitoring, and filing preparation services. We help you search the USPTO trademark database, identify potential conflicts, prepare and submit trademark applications to the US Patent and Trademark Office (USPTO) on your behalf, and monitor trademark registrations for changes.

We are not a law firm. Our services are informational and administrative in nature. Nothing we provide constitutes legal advice, and no attorney-client relationship is formed by using Searchmarq.

2. Filing Services

When you purchase a filing service, Searchmarq will:

• Prepare your trademark application using the information you provide • Submit your application to the USPTO via TEAS (Trademark Electronic Application System) within 1 business day of payment confirmation • Forward your USPTO serial number and filing confirmation to you

You are responsible for:

• Ensuring all information you provide is accurate and complete • Selecting the correct trademark class(es) for your goods and services • Confirming you have the right to use and register the mark • Responding to any USPTO office actions (we will notify you, but responding is your responsibility unless you have engaged an attorney)

3. Fees and Refunds

Our service fee covers filing preparation and submission. USPTO government fees are collected on your behalf and paid directly to the USPTO upon filing.

USPTO fees are non-refundable once your application has been submitted. Searchmarq service fees are non-refundable once your application has been filed with the USPTO.

If we are unable to file your application due to an error on our part, we will issue a full refund of our service fee.

Refund requests must be submitted to filings@searchmarq.ai within 7 days of payment.

4. No Guarantee of Registration

Filing a trademark application does not guarantee registration. The USPTO may refuse your application for a variety of reasons, including likelihood of confusion with existing marks, descriptiveness, or other statutory grounds.

Searchmarq does not guarantee that your trademark will be registered. We do not evaluate the legal strength of your mark or predict examination outcomes. A refusal of your application does not entitle you to a refund of USPTO fees, which are non-refundable regardless of outcome.

5. Accuracy of Information

You are responsible for the accuracy of all information submitted through Searchmarq. Providing false or misleading information in a trademark application is a federal offense under 18 U.S.C. § 1001 and may result in cancellation of your trademark registration.

Searchmarq is not liable for errors resulting from inaccurate information you provide.

6. Search Results and Risk Assessments

Trademark search results and risk assessments provided by Searchmarq are for informational purposes only. They do not constitute a legal clearance opinion or guarantee that your mark is available for use or registration.

Our database reflects USPTO records and may not be complete or current. Common law trademark rights (from use in commerce, without registration) are not reflected in our search results. A comprehensive trademark clearance search by a licensed attorney may reveal additional conflicts.

7. Monitoring Services

Trademark monitoring services alert you when new trademark applications are published that may conflict with your mark. Monitoring is automated and may not capture all relevant filings. Searchmarq is not liable for missed conflicts or for damages arising from a failure to detect a conflicting application.

8. Limitation of Liability

To the maximum extent permitted by law, Searchmarq's total liability for any claim arising from use of our services is limited to the amount you paid us in the 12 months prior to the claim.

We are not liable for any indirect, incidental, consequential, or special damages, including lost profits, loss of business, or trademark cancellation, even if we have been advised of the possibility of such damages.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of Searchmarq after changes constitutes acceptance of the updated Terms.
