Costs & Fees
How Much Does a Trademark Cost in 2026?
The total cost to register a trademark ranges from $250 to $2,500+ depending on how many classes you file in, whether you use an attorney, and how smoothly the examination goes. Here's exactly what you'll pay at each stage.
USPTO filing fees (the minimum you'll always pay)
Regardless of which route you take, the USPTO charges a non-refundable government fee for each class you apply in. There are two main application types:
These fees are per class. If you need two classes (e.g., Class 25 for clothing + Class 35 for retail services), you pay the fee twice. Most small businesses file in 1–2 classes.

Office Actions
If the USPTO has questions or objections, they issue an Office Action. You must respond within 3 months (extendable to 6 months for an additional fee). Attorney responses typically cost $500–$1,500 each.
Multiple classes
If your business crosses multiple categories (e.g., a software company that also sells branded merchandise), you'll pay the filing fee for each class separately.
Statement of Use (intent-to-use applications)
If you filed before actually using the mark in commerce ("intent to use"), you'll need to pay an additional $100/class when you're ready to activate the registration.
Opposition proceedings
After your mark is approved, it's published for 30 days. If a competitor files an opposition, you'll need to respond — costs can reach $10,000+ if it goes to a full hearing at the Trademark Trial and Appeal Board (TTAB).
