How Much Does a Trademark Cost in 2026?

The total cost to register a trademark ranges from $250 to $2,500+ depending on how many classes you file in, whether you use an attorney, and how smoothly the examination goes. Here's exactly what you'll pay at each stage.

Cost Summary (per class, 2026)
DIY (USPTO only)
$250–$350
TEAS Plus or TEAS Standard filing fee. No assistance.
Flat-fee service
$499–$699
USPTO fee + preparation. Searchmarq charges $499 flat.
With an attorney
$1,000–$2,500
USPTO fee + $750–$2,000+ in attorney time.

USPTO filing fees (the minimum you'll always pay)

Regardless of which route you take, the USPTO charges a non-refundable government fee for each class you apply in. There are two main application types:

Application typeFee per classRequirements
TEAS Plus$250 / classMust use USPTO's pre-approved ID Manual for goods/services description. Stricter but cheaper.
TEAS Standard$350 / classAllows custom goods/services descriptions. More flexibility, higher fee.

These fees are per class. If you need two classes (e.g., Class 25 for clothing + Class 35 for retail services), you pay the fee twice. Most small businesses file in 1–2 classes.

Costs most people don't expect

Office Actions
If the USPTO has questions or objections, they issue an Office Action. You must respond within 3 months (extendable to 6 months for an additional fee). Attorney responses typically cost $500–$1,500 each.
Multiple classes
If your business crosses multiple categories (e.g., a software company that also sells branded merchandise), you'll pay the filing fee for each class separately.
Statement of Use (intent-to-use applications)
If you filed before actually using the mark in commerce ("intent to use"), you'll need to pay an additional $100/class when you're ready to activate the registration.
Opposition proceedings
After your mark is approved, it's published for 30 days. If a competitor files an opposition, you'll need to respond — costs can reach $10,000+ if it goes to a full hearing at the Trademark Trial and Appeal Board (TTAB).

DIY vs. flat-fee service vs. attorney — which should you use?

DIY (file on USPTO.gov yourself)$250–$350
Best for
You're comfortable with legal forms and have time to learn the process
Risk
High error rate for first-timers; mistakes in description of goods/services or mark specimens commonly result in Office Actions or refusals
Flat-fee service (like Searchmarq)$499 all-in
Best for
Most founders and small businesses. You want professional preparation without attorney hourly rates.
Risk
Not legal advice — won't help with complex situations like Office Action responses or oppositions
Trademark attorney$1,000–$2,500+
Best for
Complex situations: existing similar marks in your space, businesses in heavily regulated industries, high-value brands worth protecting thoroughly
Risk
Cost — expect to pay $1,000–$2,500+ just to file, and more if complications arise
