Privacy Policy

1. Overview

Searchmarq ("we," "us," or "our") operates searchmarq.ai and its associated browser extension (collectively, the "Services"). This Privacy Policy explains what information we collect, how we use it, and your rights with respect to that information.

By using any part of the Services — including the website, trademark search, monitoring, clearance research, filing preparation, API access, or the browser extension — you agree to the practices described in this Policy.

2. Information We Collect

We collect information in the following ways:

Account & Profile Information: When you create an account, we collect your name, email address, and payment information (processed by Stripe; we do not store card numbers).

Search & Usage Data: We log search queries, marks you view, filters you apply, and pages you visit. This includes searches performed via the website, API, and browser extension.

Filing Information: When you submit a trademark application through Searchmarq, we collect the mark name, description of goods and services, applicant name and address, specimen images, and any other information required by the USPTO.

Monitor Configurations: We store the marks, serial numbers, and alert preferences you configure for trademark monitoring.

Browser Extension Data: The Searchmarq browser extension collects the text you highlight or submit for trademark lookup while using the extension. The extension does not collect your browsing history, track websites you visit, or access content outside of explicit user-initiated actions.

Device & Technical Data: We collect IP addresses, browser type, operating system, and referring URLs for security, analytics, and service improvement purposes.

Communications: If you contact us, we retain the contents of that communication.

3. How We Use Your Information

We use collected information to:

• Operate and improve the Services, including trademark search, clearance, monitoring, and filing features • Process and submit trademark applications to the USPTO on your behalf • Send monitoring alerts and filing status notifications • Authenticate your account and prevent fraud • Respond to support requests • Analyze usage patterns to improve search relevance and product features • Comply with legal obligations

We do not sell your personal information to third parties.

4. Trademark Search and Database

Searchmarq provides access to a database of USPTO trademark records that is informational and publicly sourced. Search queries you submit — including those made via the API or browser extension — may be logged for service improvement, security monitoring, and abuse prevention.

Search results reflect our database at the time of query and may not be complete or current. We make no representation that search results are accurate, exhaustive, or suitable for any legal purpose.

5. Monitoring Services

Trademark monitoring alerts are automated and depend on the availability and accuracy of USPTO data. We make no guarantee that all relevant filings will be detected or that alerts will be delivered without delay.

Data associated with your monitor configurations — including mark names and serial numbers — is stored and processed to generate alerts. We retain this data for as long as your monitoring subscription is active and for a reasonable period thereafter.

6. Filing Services

When you use Searchmarq to prepare and file a trademark application, we transmit your application data to the USPTO via TEAS. By submitting a filing through Searchmarq, you authorize us to submit this information on your behalf.

Filing data (applicant name and address, mark description, specimen images, goods and services descriptions) becomes part of the public USPTO record upon filing. Once submitted to the USPTO, this information cannot be retracted.

Searchmarq retains a copy of your filing data for account history and support purposes.

7. Browser Extension

The Searchmarq browser extension is designed to perform trademark lookups based on text you explicitly select or submit. The extension:

• Only transmits data when you take an explicit action (e.g., highlighting text to search) • Does not monitor your browsing activity or collect data in the background • Does not access page content unless you initiate a lookup • Transmits search queries to Searchmarq servers over HTTPS

Extension usage data is subject to the same policies as website usage data described in this Policy.

8. API Access

If you access Searchmarq via the API, queries made with your API key are logged and associated with your account for rate limiting, billing, and abuse prevention. Do not share your API key. You are responsible for all activity under your API key.

9. Data Sharing

We share data only as necessary to operate the Services:

• USPTO: Filing data is transmitted to the USPTO as part of the trademark application process. • Stripe: Payment processing. Stripe's privacy policy applies to payment data. • Vercel / Supabase: Infrastructure providers that store and process data on our behalf under data processing agreements. • Legal: We may disclose information if required by law, subpoena, or to protect the rights, property, or safety of Searchmarq, our users, or the public.

We do not sell, rent, or trade personal information to any third party for marketing purposes.

10. Data Retention

We retain account data for as long as your account is active. Search logs and usage data are retained for up to 24 months. Filing data is retained indefinitely for your account history.

You may request deletion of your account and associated personal data by emailing privacy@searchmarq.ai. Note that data submitted to the USPTO is part of a public government record and cannot be deleted by Searchmarq.

11. Security

We use industry-standard measures to protect your data, including HTTPS encryption in transit and encrypted storage at rest. No system is perfectly secure. We are not liable for unauthorized access resulting from events beyond our reasonable control, including data breaches affecting third-party infrastructure providers.

12. Disclaimer of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SEARCHMARQ DISCLAIMS ALL LIABILITY FOR:

• Inaccuracies, omissions, or errors in trademark search results, monitoring alerts, or database records • Failure to identify conflicting marks, including common law marks not reflected in the USPTO database • Missed or delayed monitoring alerts • Decisions made in reliance on search results, clearance reports, or risk assessments provided by the Services • USPTO refusals, office actions, oppositions, or cancellations arising from any trademark application prepared or filed through Searchmarq • Loss of trademark rights resulting from missed deadlines, incorrect classifications, or other errors in applications prepared by the user • Any unauthorized access to or loss of your data

USE OF SEARCHMARQ DOES NOT CONSTITUTE LEGAL ADVICE AND DOES NOT CREATE AN ATTORNEY-CLIENT RELATIONSHIP. ALL SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. YOU ASSUME ALL RISK ASSOCIATED WITH YOUR USE OF THE SERVICES.

13. Your Rights

Depending on your location, you may have rights to access, correct, delete, or export your personal data. To make a request, email privacy@searchmarq.ai. We will respond within 30 days.

California residents may have additional rights under the CCPA. EU/EEA residents may have rights under the GDPR. Contact us to exercise these rights.

14. Cookies

We use cookies and similar technologies for authentication, session management, and analytics. You can disable cookies in your browser settings, but doing so may affect your ability to use certain features of the Services.

15. Children

The Services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected such information, contact us at privacy@searchmarq.ai and we will delete it.

16. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Services after changes constitutes acceptance of the updated Policy.
