USPTO Statement of Use Filing Fee: What It Costs in 2026

If you filed an intent-to-use trademark application, you'll eventually need to file a Statement of Use to activate your registration. The USPTO charges $150 per class (TEAS Plus) or $200 per class (TEAS Standard) for this filing — plus extension fees if you need more time. Here's everything you need to know.

What is a Statement of Use?

When you file a trademark application before you're actually using the mark in commerce, you file on an intent-to-use (ITU) basis. This lets you lock in a priority date — the date that determines who gets rights if another applicant shows up later — without needing to have started selling anything yet.

But the USPTO won't grant you a registration until you prove you're actually using the mark. That proof comes in the form of a Statement of Use (SOU) — also called an Allegation of Use when filed before the Notice of Allowance is issued.

The SOU must include a specimen showing the mark being used in commerce (such as a website screenshot, product photo, or marketing material) along with the date of first use in commerce and the date of first use anywhere. Once accepted, your trademark moves to registration.

When do you file a Statement of Use?

After your ITU application clears examination and is approved, the USPTO issues a Notice of Allowance (NOA). From the date of the NOA, you have six months to either:

File your Statement of Use
If you've started using the mark in commerce, submit the SOU with a specimen showing use.
File a Request for Extension of Time
If you're not ready yet, request a 6-month extension. You can do this up to five times (for a total of up to 3 years from the NOA date).

The clock starts ticking from the NOA date — not the date you filed your application. Most ITU applications take 8–12 months to receive a NOA after filing, so your total runway from application to SOU deadline can be 2–4 years if you use all available extensions.

All fees are charged per international class of goods or services. If your application covers two classes, you pay double.

If you use all five extensions before filing your SOU, you could pay up to $625/class in extension fees alone ($125 × 5), on top of the $150–$200 SOU fee itself.

What happens if you miss the SOU deadline?

Missing the SOU deadline — or failing to file an extension in time — results in the abandonment of your application. The USPTO issues a Notice of Abandonment, and your filing date and priority date are lost.

You can file a Petition to Revive an abandoned application within two months of the abandonment notice, but this requires demonstrating the abandonment was unintentional and paying a $250 petition fee per class. It's a costly and uncertain process.

Critical: The USPTO does not send reminders when your SOU or extension deadline is approaching. Set calendar alerts for every 6-month window after your Notice of Allowance date.

Tips for a successful Statement of Use filing

Use the right specimen
The specimen must show the mark being used in connection with the specific goods or services listed in your application. For goods, a photo of the product with the mark visible on the packaging or label works well. For services, a website screenshot showing the mark alongside a description of the services is standard.
Match your use date to reality
The date of first use you declare in the SOU must be accurate. The USPTO can question use dates, and providing a false date constitutes fraud on the USPTO — which can invalidate your registration entirely.
File TEAS Plus when possible
If your goods/services description uses approved ID Manual entries (as required for TEAS Plus applications), you save $50/class on the SOU fee. Most ITU filers who started with TEAS Plus can continue with TEAS Plus for the SOU.
Don't wait until the last week
Technical issues with the TEAS system are not accepted as an excuse for a late filing. Submit at least a few days before your deadline to allow time for troubleshooting.
Check your application status before filing
Verify that your application hasn't gone abandoned due to a missed earlier deadline. Use the USPTO's TSDR system to confirm the current status before investing time in SOU preparation.
