Trademark Renewal Cost: Section 8 & 9 Fees Explained (2026)

A registered trademark doesn't last forever on its own — you have to maintain it. The USPTO requires periodic filings to keep your registration alive: a Section 8 declaration of continued use and a Section 9 renewal application. Combined, those cost $525 per class (TEAS Plus) at the 10-year mark. Here's the full breakdown.

The two maintenance filings: Section 8 and Section 9

Section 8 — Declaration of Use
A sworn statement that you are still using the trademark in commerce. You must include a specimen showing current use. Filed between years 5–6 after registration, then every 10 years alongside the Section 9 renewal.
Section 9 — Renewal Application
An application to renew the trademark registration for another 10-year term. Due in the 9th–10th year after registration, and then every 10 years after that. Always filed together with the Section 8 declaration after the first cycle.

Think of Section 8 as proving you're still using the mark, and Section 9 as paying to keep the registration alive. After the initial 5–6 year Section 8 window, every subsequent maintenance filing is a combined §8+9 filing due every 10 years.

TEAS Plus rates require using pre-approved goods/services descriptions from the USPTO ID Manual. TEAS Standard allows custom descriptions but costs significantly more.

Attorney costs on top of USPTO fees

The fees above are only the USPTO government fees. If you use a trademark attorney or a filing service, expect to pay additional costs:

Most attorneys charge $300–$500/hr. A straightforward Section 8 + 9 renewal typically takes 1–2 hours of attorney time ($300–$1,000 in fees), assuming no complications.
Flat-fee renewal services
Several services (including Searchmarq) offer flat-fee renewal assistance. Costs typically range from $199–$399 on top of USPTO fees.
Specimen issues
If your current specimen doesn't meet USPTO requirements (e.g., the product is discontinued or the website no longer shows the mark prominently), you'll need to gather new evidence. Attorney time to address this adds to the bill.

What happens if you miss a renewal deadline?

Missing a renewal deadline — including the grace period — results in the cancellation of your trademark registration. The USPTO cancels the registration automatically, and it becomes available for others to apply for.

Unlike an abandoned application, a cancelled registration generally cannot be revived. You would need to file a brand-new application, which means a new filing fee, a new examination queue (8–12 months), and potentially losing priority to anyone who filed in the interim.

Important: The USPTO does not send automatic reminders about renewal deadlines. Many trademark owners lose their registrations simply because they forgot. Use a docketing service, calendar reminders, or check your registration's status on the USPTO's TSDR database every year.

Trademarks can last indefinitely as long as renewals are filed and the mark remains in use. The per-class cost above does not include attorney or service fees.
